On April 13, 2011, the United District Court of New York issued an Order granting Faiveley Transport’s motion for judgment on its claims for trade secret misappropriation, unfair competition and unjust enrichment against the US company Wabtec Corporation. These claims are related to brake systems such as tread brake units and disc actuators.
This decision follows the suit filed on May 14, 2010 by the American subsidiaries of the Group, Faiveley Transport USA and Ellcon National, along with Faiveley Transport Amiens (France) and Faiveley Transport Nordic AB (Sweden).
The Court will examine the damages claimed by Faiveley Transport and decide on the amount of damages at upcoming court sessions to be held in June 2011.
In India, an arbitration court under the aegis of the Court of Arbitration of the International Chamber of Commerce issued a favourable decision on February 21, 2011 in the suit filed by Faiveley Transport Malmö against the Indian company Stone India Ltd. for breach of the provisions of the license contract for C3W relay valves mounted on braking systems.
Stone India was notably held liable for not complying with its obligations of confidentiality and secrecy and for having modified a product under license without any prior approval from the licensor. The court has also issued an injunction to refrain Stone India from selling the modified product.
Through these two law suits, Faiveley Transport Group has been able to reaffirm its legal rights on systems and products which were originally designed by the group.
